Digital Millennium Copyright Act — Takedown and Counter-Notice Procedures

Overview

MemeScreens respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond to valid notices of alleged copyright infringement and may terminate the accounts of repeat infringers.

Because MemeScreens hosts user-uploaded video clips, we recognize that copyright issues may arise. The procedures below describe how copyright owners can request removal of allegedly infringing content, and how users can respond if their content was removed in error.

How to File a DMCA Takedown Notice

If you believe that content on MemeScreens infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following:

  1. Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
  2. Identification of the infringing material — the specific URL(s) on our Site where the allegedly infringing content appears. The clearer and more specific you are, the faster we can act.
  3. Your contact information — your full name, mailing address, telephone number, and email address.
  4. Good faith statement — a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement under penalty of perjury — a statement that the information in the notice is accurate, and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Signature — your physical or electronic signature.

Incomplete or inaccurate notices may not be processed.

Counter-Notice

If you believe that content you uploaded was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice. Your counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your judicial district (or, if you are outside the United States, any judicial district in which MemeScreens may be found), and that you will accept service of process from the person who provided the original takedown notice or their agent.

Repeat Infringer Policy

MemeScreens reserves the right to terminate, in appropriate circumstances, the accounts of users who are repeat infringers of copyright.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees, incurred by the alleged infringer, copyright owner, or service provider.

Please do not submit takedown notices for content you do not own the rights to, and do not submit counter-notices for material you have no good faith belief was removed in error.
